1. Acceptance of Terms
By using the website PirogueCraft.com (referred to as "we," "us," or "our") and placing an order, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or place an order.
These terms apply to all users, visitors, and customers of our website and services.
2. Product Information and Pricing
All product descriptions, specifications, dimensions, weights, and performance data on this website are provided for guidance only. While we strive to ensure accuracy, we do not warrant that product descriptions, photographs, videos, or other content are error‑free, complete, or current.
Prices displayed on the website or provided via email/WhatsApp are estimates and may change without prior notice. The final price is confirmed at the time of order placement.
All prices are quoted in Euros (EUR) unless otherwise stated. Prices do not include shipping, import duties, customs fees, or VAT (if applicable). These costs are the responsibility of the buyer.
3. Quotations and Orders
Quotations provided by PirogueCraft are non‑binding and valid for a period of 30 days from the date of issue, unless otherwise stated in writing.
An order is only confirmed when we have issued a written order confirmation and, where applicable, received a deposit or down payment.
We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraud.
4. Payment Terms
Payment terms are agreed upon per order. Typically, we require:
- A deposit of up to 50% of the total order value to begin production.
- The remaining balance payable before shipping or delivery.
Payments must be made in Euros (EUR) via bank transfer or other agreed methods. The buyer is responsible for any bank transfer fees or currency conversion costs.
Late payments may incur interest or result in delayed delivery.
5. Delivery and Shipping
Delivery timelines are estimates and not guaranteed. We make every effort to ship your order within the agreed timeframe, but delays may occur due to factors beyond our control (see Force Majeure in Clause 10).
All boats are shipped from Senegal or The Netherlands depending on the agreement. Shipping costs, insurance, import duties, customs clearance, and VAT are the sole responsibility of the buyer.
Risk of loss or damage to the products passes to the buyer upon shipment (FOB – Free On Board). We recommend that you arrange appropriate marine transit insurance for your order.
6. Returns, Cancellations, and Warranty
- Cancellations: Orders may be cancelled within 7 days of the order confirmation, subject to a cancellation fee covering any work already performed or materials ordered. After production has started, cancellations are not accepted without full compensation.
- Returns: Due to the custom nature of our fiberglass pirogues, returns are not accepted unless the product is defective upon arrival.
- Warranty: We provide a limited warranty on the hull against material or manufacturing defects for a period of 12 months from the date of delivery, subject to normal use and proper maintenance.
- This warranty does not cover engines, electronics, seats, roofs, or other components that are fitted locally in Europe.
- This warranty does not cover damage caused by misuse, accidents, improper storage, wear and tear, or modifications made without our consent.
- Any warranty claims must be reported in writing within 14 days of discovery.

7. Limitation of Liability
To the fullest extent permitted by law, PirogueCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities.
- Loss of data or downtime.
- Damage to third‑party property.
- Claims arising from the operation of the boat, including accidents, injuries, or environmental damage.
Our total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the total purchase price paid by you for the specific product in question.
You acknowledge that you have read and understood the safety requirements and regulations applicable to operating a vessel in your jurisdiction. You are solely responsible for ensuring that your crew and guests operate the boat safely and in compliance with all applicable laws.
8. Intellectual Property
All content on this website – including text, images, videos, logos, graphics, and software – is the exclusive property of PirogueCraft or our content suppliers and is protected by Dutch and international copyright laws.
You may not reproduce, distribute, modify, display, or create derivative works of any content on this website without our prior written consent.
9. User Responsibilities
By using our website and purchasing our products, you agree to:
- Provide accurate and complete information when placing an order.
- Ensure that you have the necessary permits, licenses, and insurance to operate a vessel in your country.
- Use the boat safely and in compliance with all local, national, and international maritime regulations.
- Maintain the boat properly, including regular inspections and maintenance as recommended.
10. Force Majeure
We shall not be held liable for any delay or failure to perform our obligations under these Terms & Conditions if the delay or failure is caused by events beyond our reasonable control. This includes but is not limited to:
- Natural disasters, storms, floods, or fires.
- War, terrorism, civil unrest, or government actions.
- Strikes, labour disputes, or supply chain disruptions.
- Pandemics, epidemics, or public health emergencies.
- Technical failures, cyberattacks, or power outages.
If a Force Majeure event occurs, we will notify you as soon as reasonably possible and take reasonable steps to resume performance.
11. Governing Law and Dispute Resolution
These Terms & Conditions shall be governed by and construed in accordance with the laws of The Netherlands.
Any dispute arising out of or in connection with these terms or your use of our website shall be submitted to the exclusive jurisdiction of the competent courts of The Netherlands.
We encourage you to contact us first to resolve any disputes amicably before initiating legal proceedings.
12. Changes to These Terms
We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Any changes will be posted on this page with an updated "Effective Date."
